Even though there are some common law crimes, most crimes in the United States are legislated and therefore established by government. A crime is act so classified by federal, state or local government. Crimes may include the commission of an outlawed act or failure to perform acts mandated by law.
Criminal law involves prosecution by the government of a person for any act that has been classified as a crime. Crimes are classified according to seriousness, they include both felonies (more serious offenses -- like Murder or rape) and misdemeanors (less serious offenses -- like petty theft or jaywalking). Felonies are usually crimes punishable by imprisonment of a year or more, while misdemeanors are crimes punishable by less than a year. However, no act is a crime if it has not been previously established as such either by statute or common law.
Criminal Law distinguished from Civil Law: Criminal law involves prosecution by the government for any act that has been classified as a crime. It differs from Civil law, which involve individuals and organizations seeking to resolve legal disputes. In a criminal case the government agency, through a prosecutor, initiates the action, while in a civil case the victim brings the suit. Persons convicted of a crime may be incarcerated, fined, or both. Not only are penalties more severe for criminal acts but so are the standards of proof. The prosecutor must persuade the jury or judge "beyond a reasonable doubt" of every fact necessary to constitute the crime charged. In civil cases, the plaintiff needs to show a defendant is liable only by a "preponderance of the evidence,". It is also noteworthy that in jury trials a unanimous finding by the jury is required for a guilty finding, whereas in civil trials only a simple majority is needed to produce a finding.
All statutes describing criminal behavior can be broken down into their various elements. Most crimes (with the exception of strict-liability crimes) consist of two elements: an act, or "actus reus," and a mental state, or "mens rea." Prosecutors have to prove each and every element of the crime to yield a conviction. With the strict standards of proof required for all elements of a crime ,(beyond reasonable doubt) and the high level of agreement needed by the jury. Aggressive defenses can reasonably assure that the innocent persons are not punished for crimes they did not commit. This country holds that it is better to release persons who may be guilty than to punish a single innocent person, The Alliance Legal group takes seriously the idea that accusation is different from guilt, and that innocence exist until guilt is proven beyond any reasonable doubt. Our nation's government is founded on the principal that power is dangerous. There is no more acute forum in which that principal is illustrated than a criminal trial and no more important a protector of individual rights and of that principle than the criminal defense lawyer.
